TERMS OF
SERVICE
By signing up
with The Business Professional,
you agree to the following Terms
of Service.
This Terms of
Service Agreement provides the
terms and conditions governing
the use and promotion of The
Business Professional. You agree
to use and promote The Business
Professional in a manner
consistent with all applicable
laws and regulations and in
accordance with the terms and
conditions discussed below.
This agreement is
between The Business Professional
and all subscribers and members.
Unless the context requires
otherwise, The Business
Professional and/or their assigns
shall be referred to as "us,
we, or our" and you shall be
referred to as "you, your or
subscriber/member."
I understand that
The Business Professional and/or
their assigns does not guarantee
or predict any type of profit or
response from said services.
Subscriber irrevocably covenants,
promises and agrees to indemnify
The Business Professional and/or
their assigns and to hold The
Business Professional and/or
their assigns harmless from and
against any and all losses,
claims, expenses, suits, damages,
costs, demands or liabilities,
joint or several, of whatever
kind or nature which The Business
Professional and/or their assigns
may sustain or to which The
Business Professional and/or
their assigns may become subject
arising out of or relating in any
way to the use of the services
provided under this agreement,
including, without limitation, in
each case attorneys' fees, costs
and expenses actually incurred in
defending against or enforcing
any such losses, claims,
expenses, suits, damages or
liabilities.
Due to the nature
of the technologies and Internet
stability, The Business
Professional and/or their
assigns, may experience service
interruptions. No full, partial,
or prorate refunds will be made
as adjustment for any such
service interruption. Subscriber
hereby acknowledges that changes
in the nature of the services
which may be offered under this
agreement which are beyond the
control of The Business
Professional and/or their assigns
do not constitute grounds for any
full or partial refund of any
advance fees paid.
A. Termination.
We may terminate your account:
(1) If any
payments under this Agreement,
are returned unpaid.; (2) if you
violate our Terms Of Service
Policy; (3) if you breach any
term of this agreement.
B. No Warranties.
WE MAKE NO WARRANTIES TO YOU OF
ANY KIND, EXPRESSED OR IMPLIED,
WITH RESPECT TO THE SERVICE The
Business Professional ITS
SUBCONTRACTORS AND AFFILIATES
PROVIDE YOU. WE EXPRESSLY
DISCLAIM ANY IMPLIED WARRANTY OF
MERCHANTABILITY OR FITNESS OF
THIS SERVICE. We shall not be
liable for any damages suffered
by you, whether indirect,
special, incidental, exemplary,
or consequential, including, by
not limited to, loss of data or
service interruptions, regardless
of cause or fault. We are not
responsible for your lost profits
or for your loss of data or
information. If notwithstanding
this clause we are held liable to
you.
While we take all
reasonable precautions to ensure
your database is secure and
protected. You understand and
agree that we are under no
obligation to export, extract,
retrieve or "massage"
your database for you.
C. TERMS. You
agree: (1) to use our system in a
manner that is ethical and in
conformity with community
standards; (2) to respect the
privacy of other users (you shall
not intentionally seek data or
passwords belonging to other
users, nor will you modify files
or represent yourself as another
user unless explicitly authorized
to do so by that user); (3) to
respect the legal protection
provided by copyright law, trade
secret law, or other laws
protecting intellectual property.
4) to accept commercial email and
similar offers presented through
the The Business Professional
system.
If we learn of a
violation or likely violation of
our TERMS OF SERVICE, we will
attempt to notify you. If you do
not take immediate remedial
action which is satisfactory to
us, or in the event of a serious
violation of the TERMS OF
SERVICE, we reserve the right to
terminate your account
immediately. Every effort will be
made to inform you prior to
account termination, and to
re-establish your account upon
receiving such representations
from you as we deem appropriate
in the circumstances.
We strictly
prohibit any involvement in UCE
campaigns, commonly known as
SPAM. As such, by submitting to
the terms outlined in our Terms
of Service, you are also bound to
the policies contained in our
Spam Policy. Please read our Spam
Policy.
You agree to
indemnify and hold us harmless
from any claim resulting from
your use of this service which
damages any person.
D. Assignment.
This agreement is personal to
you. You may not assign your
rights under this agreement
without our prior written
consent. If you do assign your
rights, as would be the case were
someone other than you to use
your account, you shall remain
liable to us for any fees due
under this agreement. We may
assign this agreement at any
time.
E. Change of
Terms and Conditions. We reserve
the right to change the terms and
conditions of this agreement as
needed. Use of our servers by you
after said changes constitutes
acceptance of those new terms and
conditions. If you do not agree
to the new terms and conditions,
you may terminate this agreement
in accordance with our
cancellation policy.
F. Notification
of Account Changes. You agree to
provide us with such other
information relating to your use
of this service as we deem
necessary or desirable. You agree
to notify us if your address,
email address, telephone number,
billing information changes.
G. Notices. All
notices, requests, demands, and
other communications under this
agreement shall be in writing and
shall be deemed to have been
given on the date of delivery: if
delivered personally to the party
to whom notice is to be given; if
sent by electronic mail with a
cc: to sender; if sent by fax; or
on the third day after mailing by
first class mail.
H. General
Provisions. The subject headings
of the articles and sections are
for convenience only, and shall
not affect the construction or
interpretation of any of its
provisions. If any portion of
this agreement is found invalid
or unenforceable, that portion
shall be severed and the
remainder of this agreement shall
remain in force. This agreement
constitutes the entire agreement
between us pertaining to its
subject matter and supersedes all
of our prior agreements,
representations, and
understandings. Subject to
Section I, no supplement,
modification, or amendment of
this agreement shall be binding
unless executed in writing by
both parties. No waiver of any of
the provisions of this agreement
shall be deemed, or shall
constitute, a waiver of any other
provision, whether or not
similar, nor shall any waiver
constitute a continuing waiver.
No waiver shall be binding unless
executed in writing by the party
making the waiver. This agreement
may be executed in one or more
counterparts. Each shall be
deemed an original, but all of
which together shall constitute
one and the same instrument. If
an organization is the
subscriber, the individual
signing up for our services
represents that he or she is duly
authorized to enter into this
agreement on behalf of that
organization. In the event of a
dispute, the parties agree to
submit the matter to the
Community Dispute Resolution
Service or any recognized
Arbitration Board located within
our state and county, before
instituting litigation.
I. Paying by
Check. Any account that has had
two (2) checks returned NSF (Not
Sufficient Funds) will no longer
be allowed to pay by check. A
credit card must be used from
that point on.
PRIVACY
STATEMENT
Welcome to The
Business Professional (the
"Site").
We understand that privacy online
is important to users of our
Site, especially when conducting
business. This statement governs
our privacy policies with respect
to those users of the Site
("Visitors") who visit
without transacting business and
Visitors who register to transact
business on the Site and make use
of the various services offered
by The Business Professional
(collectively,
"Services")
("Authorized
Customers").

Authorized Customer intends to

In addition to our direct
collection of information, our
third party service vendors (such
as credit card companies,
clearinghouses and banks) who may
provide such services as credit,
insurance, and escrow services
may collect this information from
our Visitors and Authorized
Customers. We do not control how
these third parties use such
information, but we do ask them
to disclose how they use personal
information provided to them from
Visitors and Authorized
Customers. Some of these third
parties may be intermediaries
that act solely as links in the
distribution chain, and do not
store, retain, or use the
information given to them.
How does the Site use
Personally Identifiable

We use Personally Identifiable
Information to customize the
Site, to make appropriate service
offerings, and to fulfill buying
and selling requests on the Site.
We may email Visitors and
Authorized Customers about
research or purchase and selling

contact Visitors and Authorized
Customers in response to specific

party vendors. We also offer the
opportunity to "opt
out" of receiving
information or being contacted by
us or by any agency acting on our
behalf.

Information collected by The
Business Professional is securely
stored and is not accessible to
third parties or employees of The
Business Professional except for
use as indicated above.

available to Visitors regarding

Visitors and Authorized Customers
may opt out of receiving
unsolicited information from or
being contacted by us and/or our
vendors and affiliated agencies
by responding to emails as
instructed, or by contacting

Cookies are used for a variety of
reasons. We use Cookies to obtain
information about the preferences
of our Visitors and the services
they select. We also use Cookies
for security purposes to protect
our Authorized Customers. For
example, if an Authorized
Customer is logged on and the
site is unused for more than 10
minutes, we will automatically
log the Authorized Customer off.
How does The Business
Professional use login
information?
The Business Professional uses
login information, including, but
not limited to, IP addresses,
ISPs, and browser types, to
analyze trends, administer the
Site, track a user's movement and
use, and gather broad demographic
information.
What partners or service
providers have access to
Personally Identifiable
Information from Visitors and/or
Authorized Customers on the Site?
The Business Professional has
entered into and will continue to
enter into partnerships and other
affiliations with a number of
vendors. Such vendors may have
access to certain Personally
Identifiable Information on a
need to know basis for evaluating
Authorized Customers for service
eligibility.
Our privacy policy does not cover
their collection or use of this
information. Disclosure of
Personally Identifiable
Information to comply with law.
We will disclose Personally
Identifiable Information in order
to comply with a court order or
subpoena or a request from a law
enforcement agency to release
information. We will also
disclose Personally Identifiable
Information when reasonably
necessary to protect the safety
of our Visitors and Authorized
Customers.

All of our employees are familiar
with our security policy and
practices. The Personally
Identifiable Information of our
Visitors and Authorized Customers

deactivate Personally

Authorized Customers with a
mechanism to delete/deactivate

Authorized Customers know about

AFFILIATE
AGREEMENT
This Reseller
Agreement (the
"Agreement") contains
the complete terms and conditions
which govern your participation
in the The Business Professional
affiliate program.
Pay-Out Schedule
Minimum check
amount is $50.00.Commissions are
paid for all service plans.
Commissions are paid on accounts
that have paid for their service.
Commissions will accrue
immediately, but will be paid the
month following after account
sign-up. All payments are sent
between the 20th and 25th of the
month for the previous months
sales and recurring customer
payments.
The Business
Professional reserves the right
to change this information,
affiliate terms and payment
policies at any time. Referral
tracking is held for 1 year, if a
customer clicks on your referral
link and signs up within 1 year,
you receive referral credit for
sale.
You will receive
credit every time your referred
customer purchases from The
Business Professional. We use
cookies to insure if they return
to The Business Professional, you
will still make commissions from
that referral for 1 year after
initial referral. Recurring
commissions will be paid as long
as customer's account remains in
current paid status.
In order for you
to get PAID on a sale, the
referral MUST click off your link
or banner. The code MUST be the
exact code generated by The
Business Professional. That is
the ONLY way we can track your
commission.
If a referral
does not have your referral ID
listed in their account you must
notify us before the next
commission pay out date.
Commission and or referrals can
not be claimed and will not be
paid beyond the next pay out
date.
Method Of Payment
Payment will be
made by US Check or PayPal.
Enrollment In The
Program
To enroll as a
participant in the affiliate
program, simply click the Easy
Profit Program link within your
members area. You must not
use or display on the affiliate
link any hypertext links provided
to you by The Business
Professional in a manner that is
defamatory, misleading, libelous,
obscene or otherwise potentially
damaging to the reputation of The
Business Professional.
You Must not use
the link in any of these ways;
Violate any
state, federal or foreign laws or
regulations.
NO SPAM EMAIL SOLICITATION
ALLOWED
Accounts will be suspended if
SPAM occurs!
Infringe on any intellectual
property rights.
Are defamatory, slanderous or
trade libelous.
Are threatening or harassing.
Are discriminatory based on
gender, race, age or promote
hate.
I further understand that should
I choose to take advantage of The
Business Professional's referral
program, I am not entitled to
refer myself or my own company
and receive commission on these
transactions.
REFUND
POLICY
Refunds for
annual subscribers:
Anyone
subscribing to an annual
membership will have their credit
cards charged the full amount of
the service when they sign up.
1. Should
cancellation be requested within
30 days of the billing date, your
credit card will be refunded 100%
of the annual fee charged for the
subscription.
2. For
cancellation 31 - 90 days after
the initial subscription, your
credit card will be refunded 50%
of the total subscription fee
charged for the subscription.
3. If you cancel
91 - 180 days after the billing
date, your refund will be 25% of
the annual subscription fee
charged for the subscription.
4. Should you
decide to cancel any time 180
days into the subscription, or
any time thereafter, you will not
be entitled to a refund.
Refunds for
monthly subscribers:
Any client
subscribing to our services on a
monthly basis will have their
credit cards charged the full
monthly charge for the service in
advance.
CANCELLATION
POLICY
To cancel an
account, we require that you
provide the following:
The person's name
on the account
The last four digits of the
Credit Card on the account
Email address on the account
Username and Password
